4 days ago i brought a VPS for personal use, i paid 4 months on the VPS up front, yesterday i got a email from them saying i was using too much resources (which is not possible because a VPS is only able to use what is allocated to it)
Although this is the case i completely stopped the script, after 4 hours of the script being stopped the VPS was terminated without any warning, i opened a paypal dispute about this and they said that the VPS was using "all server resources" so i got on live chat with them, here is what they said ![]() Has anyone else had problems with them, i advise anyone NOT to use this company, they are a complete SCAM |

Hello, this is Victor from Primary VPS. Let us start in reverse order...
"i have also noticed they only started the company @ 2007-04-13" We never denied we were a new company, we even had advertisements saying 20% Grand Opening sale... Now let us go to your original post How are we a fraud? We only stopped your VPS this morning after you filed a claim with paypal saying you did not receive the item, when you actually did. You were the one that kept breaking our TOS non-stop located at http://www.primaryvps.com/tos/index.htm . Since you want to make it all public, I shall do the same. You were the one using bit torrent and downloading and uploading movies, you went through 45GB of bandwidth in under half a day. We told you to stop using bit torrent which is stated as not allowed in our TOS and besides that fact you were not even using it for legal purposes. Now let us go to number 2, where you are harassing and yelling at my staff members for no reason even though they are not the ones in charge of this case, "Daniel: Hi, how can I help you? Now in conclusion: 1) Learn to have some respect when you are talking to people and stop swearing at them, it will not help anything, especially when they tell you they do not know what you are talking about. 2) Learn to read the terms of service and to not use bit torrent illegally and also disobey our TOS 3) Do not try to lie to people saying it was "based on resources" |

pipsta if you were using bit torrent then you were breaking there tos and 45 gigs of bandwidth is alot.
Did you read the TOS before complaining? Quote:

They said it was based on resources on paypal, and in the email they said i could use torrentflux (web seeding app) as long as i didnt max out the connection, which 40kbps max upload is NOT maxing the connection, unless they are hosting the vps on a 1mbps line...

You do know paypal is a payment company/system right? We could not of said anything on paypal about it being based on resources when you signed up, and we did not say you could use torrentflux or any kind of torrents. It is clearly stated as illegal, in our TOS. Also it is not possible that we could of said we allowed it because also stated in our TOS is:
"This Agreement together with the Order and AUP constitutes the complete and exclusive agreement between the parties regarding its subject matter and supercedes and replace any prior understanding or communication, written or oral." In addition to besides you doing that, you do know how fast you were downloading when you downloaded 40gb + in under half a day. Also download movies is illegal, here is a small sample of what pipsta was downloading.. " Hmm seems you were mis-using the VPS, and it seems a VPS is a resource. 2) Good job using an email in the wrong way, you were begging us not to terminate your account after you violated the TOS. So I was willing to let you stay if you stopped using the bit torrent services, even though our TOS says immediate termination for Bit torrent usage, and I offered you an exception of not being terminated and only getting a warning. Then you said "no, I paid for it so I will keep using it", then you got that email you just tried to use out of context. P.S. Nice job of self incrimination there with your limewire in your screenshot. |

You said i could stay if i didnt use more that a certain amout of upload speed, or if i upgraded the damn account you fool EDIT: So what if limewire is there, is it ilegal to use now... err nope!!! Last edited by pipsta : 05-18-2007 at 00:52. |

No, we did not say that, we clearly stated to read the TOS, and at the TOS it says

Second: We told you that was clearly illegal and we would let you stay if you stopped using it. Then you continued using it even though I gave you a second chance, even though I had no reason to. Then you kept using bi torrent. So I sent you an email saying I offered you an exception of not having your account terminated, but you had to keep using bit torrent.. Third: "11. Requests for Customer Information. Customer agrees that Primary VPS may, without notice to Customer, (i) report to the appropriate authorities any conduct by Customer or any of Customer’s customers or end users that Primary VPS believes violates applicable law, and (ii) provide any information that it has about Customer or any of its customers or end users in response to a formal or informal request from a law enforcement or regulatory agency or in response to a formal request in a civil action that on its face meets the requirements for such a request." Since this took place on US property by an UK Citizen I am forced to report all your illegal activity to both UK and US authorities. 4) You really should watch your language and grow a larger vocabulary. |
